Americans For Safe Access Marijuana Reclassification Appeal Denied
The Supreme Court has rejected Americans For Safe Access appeal to reclassify marijuana after a lower circuit court had rejected the organizations appeal to reclassify marijuana from its current Schedule 1 classification.
Schedule 1 drugs include heroin and LSD and are considered to have no medical value. There is a huge amount of evidence presented showing that medical marijuana does have medical uses but the DC Circuit Court of Appeals refused to accept it.
This is the third time such a request has failed and there is a fourth request pending, led by medical marijuana states, Rhode Island and Washington.
It is unfortunate that the Supreme Court failed to take the lead and hear the case. It seems no one wants to step on the DEA’s toes or upset the proverbial apple cart.
The lower court refused to accept anything but Phase II and Phase III clinical trials to prove marijuana”s medical value . These types of trials are reserved for companies that are trying to bring a new drug to market.
In essence this decision creates an impossible to circumvent Catch 22. Because of marijuana’s classification it is impossible for researchers to obtain it legally and its status also prevents research grants to do these clinical trials. There are currently 20 states that have legalized medical marijuana and for the first time the majority of American voters favor legalization.
