Navigating New York’s Strict Cannabis Laws: Where Freedom Meets Regulation


Don’t expect to see flashy billboards promoting cannabis stores in New York. Legal cannabis shops are confined by rigorous regulations that prevent them from offering sales or eye-catching promotions. Unlike conventional businesses, even those with heavy regulations like liquor stores, the cannabis industry in New York faces far stricter and more intricate rules.

Aleece Burgio, an authority in cannabis law, points out that cannabis regulations are even more restrictive than those governing the already complicated alcohol industry. “The government has essentially micromanaged the cannabis business,” Burgio states.

Let’s delve into some of the tightest regulations governing New York’s cannabis market.

Zero Discounts Allowed Aaron Van Camp, owner of Dank—the first recreational dispensary in Western New York—shares his frustration over the rule he finds most bizarre. “I’m not allowed to give discounts, not even to veterans,” says Van Camp. State guidelines strictly forbid dispensaries from advertising any form of discounts, giveaways, or even customer loyalty programs.

Unfair Advantage for Unlicensed Shops This rule gives an unfair advantage to unlicensed shops that are not bound by state regulations. They can lure customers with sales and freebies, while licensed shops are severely restricted in their marketing strategies.

No Promotional Swag Expect no freebies from legal cannabis stores. State guidelines strictly forbid them from offering any promotional merchandise—be it T-shirts, stickers, or any other branded items.

Limitations on Indoor Lighting for Growers If you’re cultivating cannabis, be aware that you’re allowed only 20 artificial lights. This puts traditional growers at a disadvantage compared to Registered Organizations (ROs) who face no such limitations and usually have deeper pockets.

Limited Dispensary Advertising Dispensaries can display only two signs and these come with stringent restrictions. The signs can only display essential information like the company name, address, and contact info, putting a damper on any creative marketing efforts.

The Home-Grow Catch-22 Although the Marihuana Regulation and Taxation Act (MRTA) permits home cultivation eventually, it’s still in limbo. The slow roll-out of legal retail sales has left consumers in a peculiar situation: They can’t grow cannabis at home but also have limited options to buy it legally.
